Terms of Use

Last updated: October 21, 2026

Acceptance of Terms

By downloading, accessing or using Old Ways, you agree to these Terms of Use and acknowledge our Privacy Policy. If you do not agree, please do not use Old Ways. You must be old enough to enter a binding agreement where you live, or use Old Ways with the permission of a parent or guardian.

About Old Ways

Old Ways is an application for exploring historical maps, visualizing terrain, and georeferencing your own maps and photographs. It also includes field tools such as distance and elevation measurement and saved points. Old Ways is a digital service: it gives you access to features and to historical materials, but it does not sell you those materials.

What You Pay For

Payments you make in connection with Old Ways, such as buying Energy packs, are payment for access to digital services and functionality provided by Old Ways. The service includes access to historical cartographic materials, map discovery, map preparation and processing, server-side geospatial operations, access verification, cloud storage and map delivery, security and authentication, maintenance, technical support, and ongoing operation and development.

Together these make up the service and the infrastructure that supports it. They are not itemized or charged as separate products. A payment is not the purchase of a map, of any copyright or of any other intellectual property right, and it is not a licence fee for the underlying historical materials.

Accounts and Guest Use

You can use some features of Old Ways as a guest, with limits that we show in the app. Other features require an account, which you create by signing in with Google or Apple. You are responsible for activity on your account and for keeping your sign-in secure. Do not share your account or use another person’s account.

We may limit, suspend or disable an account that breaches these Terms, is used for fraud or abuse, or creates risk for the service or other users.

License to Use Old Ways

We grant you a personal, non-exclusive, non-transferable, revocable license to use Old Ways on your own devices for personal, non-commercial purposes, subject to these Terms and to the terms of the app store you downloaded it from.

Energy

Energy is a virtual unit used inside Old Ways. It is not money, a cryptocurrency, an investment, a deposit, a bank balance, a transferable financial asset or legal tender, and it is only usable within Old Ways.

  • You can obtain Energy by buying Energy packs through the Apple App Store or Google Play, or through rewards such as a welcome bonus, promo codes and vouchers, or an adjustment we make to your balance.
  • You can spend Energy on subscriptions, on unlocking permanent access to historical maps and on satellite imagery rentals. Prices are shown in the app before you confirm.
  • Energy balances do not currently have an expiry date, and Old Ways does not provide a way to transfer Energy to another account.
  • If the store refunds or reverses an Energy pack purchase, we may deduct the Energy that purchase gave you, even if you have already spent it. In that case your balance may become negative until it is restored.
  • Payments for Energy packs are handled by the app store, and its payment, billing and refund terms apply. Nothing in these Terms limits any statutory consumer right you have, including any right of withdrawal or refund.

Subscriptions

Old Ways offers PRO and PREMIUM subscriptions. A subscription gives you access to features and to historical maps in the corresponding access tier for the subscription period, which is shown in the app. A subscription gives you access, not ownership of any map.

Subscriptions are paid for with Energy, not directly with money. You can choose whether a subscription renews automatically. If it renews automatically and you do not have enough Energy at renewal, it will not renew and your access ends when the current period ends. You can turn automatic renewal off in the app before it renews. Because subscriptions are paid with Energy, they are not managed in your app store subscription settings. They are Old Ways access tiers that Old Ways renews through its own system, not recurring Apple or Google subscriptions.

When your subscription ends, you lose access to maps that were available only through it. Maps you have unlocked with permanent access remain available as described below.

Historical Maps and Permanent Access

A historical map can be available through a subscription, free of charge, or through permanent access. Some maps are available only through permanent access.

When you spend Energy to unlock permanent access to a map, or receive it as a reward, your account receives an access entitlement to use that map in Old Ways. It has no scheduled expiry date and does not depend on a subscription. It stays available for as long as the map remains available through Old Ways, as described below.

Permanent access is access to a service. It does not make you the owner of the map or of the historical document behind it, and it does not give you any copyright or other intellectual property right in it. It also does not give you the right to copy, publish, sell or redistribute the map.

Permanent access lasts for as long as Old Ways offers the map and operates the service. We may need to change, replace or remove a map or a feature, for example because of a legal requirement or a rights complaint, a security or technical issue, or if we discontinue the service. We will keep this to what is reasonably necessary and, where we can, give notice. If we replace a map with an updated version, your permanent access carries over and you can download the new version without paying again. Some protected maps must reconnect to our servers from time to time to confirm access, so you need an internet connection now and then.

If we permanently remove an individual map that you unlocked with Energy while Old Ways continues to operate, we will tell you the reason, apologize, and credit your Energy balance with double the Energy you spent on it. A complete discontinuation of our online services is handled under Discontinuation of Online Services below and does not by itself apply this credit to every map.

Satellite Imagery (Red Diamond)

Red Diamond lets you rent satellite imagery of a map square for a chosen period. Each square and period you order is one unit. A unit costs 1 Energy, which is charged in full when you place the order. PREMIUM subscribers can hold up to 4 units at a time without spending Energy.

A rental lasts 30 days from the moment you order. We prepare the imagery after you order, which can take up to 72 hours. If it takes longer, the extra days are added to your rental, rounded up to whole days. If a unit cannot be prepared, including when it is still not ready when the 30 days end, the Energy you paid for it is returned to your balance.

You can extend a rental for another 30 days. Extending an Energy rental costs 1 Energy for each unit that is ready. If you extend before the term ends, a new 30 days starts from that moment and the time that remained is not added.

A rental paid with Energy cannot be removed before its term ends. A PREMIUM rental can be cancelled. If your PREMIUM access ends, the rental is paused, and you can restore it when PREMIUM is active again and you have free places, as long as its term has not ended. When the term ends, access to the imagery ends.

A rental is access to a service. It does not transfer any rights in the imagery. Satellite imagery works online only.

Historical Cartographic Materials and Rights Holders

Old Ways provides access to historical cartographic materials obtained from publicly accessible archives, collections, websites and other sources. Because of the age and historical nature of some materials, their original authorship, provenance, copyright ownership or applicable licensing terms may be incomplete, uncertain or unavailable.

Public accessibility does not necessarily mean that a material is in the public domain or free from copyright restrictions. Old Ways does not claim ownership of third-party historical materials, and access to them through the service does not transfer any intellectual property rights to you. Access through Old Ways is for exploring and research within the app. It does not automatically grant you reproduction, publication, commercial-use or redistribution rights, and you are responsible for checking the rights that apply before you export, share or publish any material.

We respect the legitimate rights of authors, archives, institutions and other rights holders. If you believe that material available through Old Ways infringes your rights, please contact us at vadym.bezsmertnyi@gmail.com, identifying the material and explaining the basis of your claim. We will review sufficiently detailed notices and take appropriate action where warranted, which may include correcting attribution, restricting access or removing the material.

Bonuses, Promo Codes and Vouchers

Old Ways may offer promotional benefits to registered accounts, such as a welcome bonus of temporary subscription-level access, single-use promo codes and vouchers that can grant Energy, temporary subscription-level access or permanent access to specific maps, and bonuses that let you choose a map. Promotional benefits have no cash value, cannot be sold, exchanged or transferred, and belong only to the account that receives them.

Each promo code or voucher can be used once and may expire or be withdrawn before it is used. Temporary promotional access is separate from any paid subscription and ends when its period ends. We may limit repeated invalid code attempts and may refuse or remove benefits obtained through misuse, fraud or error.

The welcome bonus is granted under the terms of the offer in effect when you register. Its length can differ between app versions and can change over time. It is not a fixed or permanent commitment, and the length that applies to you is shown in the app when the bonus is granted. A bonus that has already been granted is not shortened because the offer changes later.

A welcome bonus is granted once for a verified email address, within the limits of the eligibility history we keep (see our Privacy Policy). Deleting your account and registering again does not guarantee a new welcome bonus.

A welcome bonus has no cash value and cannot be exchanged for money. It does not change or shorten a paid subscription or access rights you have purchased.

Custom Terrain Coverage Requests

You can submit an area to request custom terrain coverage. A request is handled manually. Submitting one does not guarantee that we will fulfill it, and any price or arrangement for fulfilling it is confirmed separately.

Your Content

You keep all rights in the maps, photographs, georeferenced projects, points and other content you import or create in Old Ways. We do not claim ownership of it. Your content is processed and stored on your device, and you are responsible for your own backups.

You are responsible for making sure that you have the necessary rights, including copyright, to use content you import, and for the accuracy of any real-world coordinates you assign to it. If you send us content, such as the outline of an area for a terrain coverage request, you give us only the limited right to store and process it as needed to provide the service you requested.

Intellectual Property

Old Ways, including its software, design and original content, is owned by its developer and protected by applicable intellectual property laws. Except for the license above, these Terms do not transfer any rights in Old Ways to you.

Prohibited Use

You agree not to:

  • Use Old Ways for any unlawful purpose or in violation of applicable laws or regulations;
  • Attempt to interfere with, disrupt or gain unauthorized access to Old Ways’ servers, accounts or infrastructure;
  • Bypass or attempt to bypass access controls or the protection of maps, or copy, extract, scrape or redistribute maps or other materials from Old Ways;
  • Abuse promotions, promo codes or the Energy system, or create accounts to do so;
  • Reverse engineer, decompile or attempt to extract the source code of Old Ways, except where permitted by law;
  • Import or upload content that you do not have the right to use.

Accuracy and Professional Use

Historical maps, georeferenced overlays, terrain and elevation visualizations, measurements of distance and area, and GPS or other location data displayed in Old Ways may contain inaccuracies, gaps or errors, including due to the age or quality of historical source material, limitations of terrain data, your georeferencing inputs, or the accuracy limits of your device’s positioning technology.

Old Ways is a research and field exploration tool. It is not a survey instrument, a cadastral or legal boundary source, a certified navigation or safety system, an emergency service, or an authoritative historical or geographic source. Do not rely on it as the sole source for navigation, professional surveying, legal boundary determination, emergency response or any other high-risk decision. Always use appropriate official sources, instruments and professional judgment for such purposes.

Availability and Offline Use

Some Old Ways features, such as the historical map archive, terrain data, elevation measurement, place search, sign-in, Energy and subscriptions, require an internet connection and depend on our servers and on third-party services. Maps you have downloaded for offline use are stored on your device but are protected: they can be used without a connection for a limited time, after which Old Ways must reconnect to confirm access. Other features, such as georeferencing your own maps and your local tools, work mainly on your device.

Temporary outages, maintenance, technical incidents and interruptions can happen. We may carry out maintenance and, where needed for security, legal or technical reasons, suspend part of the service, and we will give notice where reasonably possible. We make reasonable efforts to restore affected functionality, but we do not promise a fixed recovery time and we do not guarantee that any feature will be available uninterrupted or error-free. An interruption does not by itself entitle you to compensation, but this does not limit any right you have under applicable law.

Third-Party Services

Old Ways relies on third-party services, including the Apple App Store and Google Play, Firebase and other sign-in providers, RevenueCat, and map, hosting, database and storage providers, to operate. Your use of those services is also subject to their own terms, and an outage or change on their side can affect Old Ways. Apple and Google are not responsible for Old Ways or for providing support for it.

Old Ways includes Google Maps features and content. Your use of them is subject to the then-current Google Maps End User Additional Terms of Service and the Google Privacy Policy, available at:

The Red Diamond feature in Old Ways is created using Copernicus Sentinel-2 satellite data. The notice that applies to it is the following, where [Year] is the year of the satellite data used, not the date this document was last updated:

  • Contains modified Copernicus Sentinel data [Year]

Events Beyond Our Control

We are not responsible for a failure or delay in providing Old Ways to the extent that it is caused by an event beyond our reasonable control that we could not reasonably have prevented or avoided. Examples can include war or armed conflict, natural disasters, fire or flooding, major power or telecommunications outages, cyberattacks that reasonable security measures could not prevent, government restrictions, changes in law or regulation, and the unavoidable loss of essential infrastructure.

Ordinary software bugs, preventable operational mistakes and routine technical incidents are not events beyond our control. When such an event does occur, we will make reasonable efforts to limit its effect and to restore the service. This section does not limit any right or remedy you have under mandatory consumer law or under the rules of the app store you used.

Goodwill Gestures

After a service problem we may, at our discretion, offer goodwill benefits such as additional Energy, a temporary access upgrade, an extension of an Old Ways access period or another in-app benefit. We do not promise a benefit for every interruption or inconvenience, and we do not offer cash compensation for ordinary inconvenience.

A goodwill benefit has no cash value. It does not replace or limit any refund, remedy or consumer right you have under applicable law or under the rules of the app store you used.

Discontinuation of Online Services

Many parts of Old Ways depend on online services that must be paid for and maintained. If we become unable to maintain some or all of them for financial, technical or legal reasons, we may discontinue them in part or entirely. Where it is reasonably feasible, we will give advance notice in the app and on our website. If a legal, security or technical emergency requires it, we may act without advance notice.

If online services are discontinued, features that depend on them may stop working, including the online historical map catalog, remote map tiles and files, downloads, terrain, elevation and place search, sign-in, access verification, Energy and purchases. Data stored in the cloud and remote map assets may become unavailable or be deleted, subject to our legal obligations, to the Privacy Policy and to the commitments in these Terms.

Maps and projects you imported or created yourself, and your saved points, stay on your device until you delete them or remove the app, and whether they stay usable depends on the app, the integrity of the files and your device. Downloaded historical maps are encrypted and need access to be confirmed by our servers from time to time. If our servers stop permanently, a downloaded historical map may become unusable even though its file remains on your device. Signing out of the app or changing your sign-in identity can remove downloaded historical maps from the device. If you reinstall Old Ways or change devices, you may need to download maps again, and that may no longer be possible.

We may consider offering a version of Old Ways that works mainly or entirely offline. That version does not exist today, it would require additional development, and we do not promise that it will be offered or what it would contain.

If we ever offer such a version, we intend, where technically and legally feasible, to preserve your unused Energy and to take your existing access entitlements and access periods into account. This is an intention, not a guarantee, and you have not agreed to any future conversion. Your unused Energy is not automatically forfeited or used up merely because online services stop or because such a version is offered. How Energy, access periods and unlocked maps would be treated, and how you would be told, would be decided and announced at that time, in line with applicable law.

Nothing in this section, and no discontinuation or transition, removes any right to a refund or other remedy that you have under applicable law or under the rules of the app store you used, or reduces the credit described in Historical Maps and Permanent Access for the removal of an individual map. A complete discontinuation of our online services is not treated as the removal of each individual map for that credit, and the credit is not applied automatically to every map because of it. Instead, this section governs notice, any transition, and the treatment of outstanding entitlements and unused Energy, which will be announced at that time in line with applicable law. This clarification applies from the “Last updated” date and does not take away any credit you have already become entitled to. We do not guarantee that Firebase or any other third-party service will remain available.

Suspension, Termination and Account Deletion

You can stop using Old Ways at any time, and you can delete your account in the app as described in the Privacy Policy. We may suspend or end your access if you breach these Terms or if we are required to by law. When you delete your account, your sign-in is removed and the account can no longer be used. If it has permanently unlocked maps, an Energy balance or an active subscription, we keep it, without your contact details, so that you can restore it by signing in again with the same verified email address. Otherwise it is kept for six months and then erased, after which it cannot be restored and anything still linked to it is lost. Deleting your account turns off automatic renewal of any Old Ways subscription.

Disclaimers

Old Ways is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, regarding Old Ways, including but not limited to the accuracy of the maps, terrain, measurements and location data described above.

Limitation of Liability

To the fullest extent permitted by applicable law, Old Ways and its developer will not be liable for any indirect, incidental or consequential damages arising from your use of, or inability to use, Old Ways, including reliance on historical map, terrain or location data. Nothing in these Terms, including the sections on availability, events beyond our control, goodwill gestures and discontinuation of online services, limits any liability or any consumer right that cannot be limited under the law that applies to you.

Changes to the Service or These Terms

We may update Old Ways and these Terms of Use from time to time. When we make a significant change, we will update the “Last updated” date and, where appropriate, tell you in the app. Continuing to use Old Ways after changes take effect means you accept the updated Terms.

We will not use a change to these Terms to reduce access that you have already unlocked or paid for, except as these Terms already provide or as the law allows. If we discontinue online services or make another material change that affects paid features, we will tell you in the app where reasonably possible. Nothing in this section limits any right you have under applicable law.
